Business attorney and litigator Jose Pomposo Barajas has a diverse practice that includes employment law, complex commercial litigation, Chapter 11 matters, Subchapter V bankruptcies for small businesses, general creditors’ rights, and commercial real estate transactions.
Jose has defended employers of all sizes in various industries against wage & hour class actions and PAGA representative actions involving classes numbering from dozens to tens of thousands. He also defends employers in individual actions alleging discrimination, harassment and wrongful termination.
In the area of creditors’ rights, Jose has a range of experience, which includes representation of a large national manufacturer-creditor in a high-stakes controversy. Jose successfully obtained a nearly $1 million writ of attachment against the entity and guarantor defendants. Jose also served on a trial team in a complex multi-state enforcement of judgment action where he assisted with law and motion practice and in the mock trial process.
Jose’s work in commercial real estate includes drafting commercial and industrial property leases, purchase and sale agreements, as well as more unique forms of ownership, including membership interest purchase agreements. He also helps with the formation of deal-specific business entities and reorganization of existing entities.
A graduate of University of California, Hastings College of the Law, and University of California, San Diego, Jose expanded his international experiences in study programs at Sweden’s Lund University and Denmark’s University of Copenhagen.
Jose is a proud son of immigrants from the Mexican states of Puebla and Jalisco, and he speaks Spanish fluently. His understanding of small business ownership comes from years of overseeing his family’s landscape construction company.
