OVERVIEW

Trial lawyer and litigator Ian M. Green focuses his practice on toxic tort defense, catastrophic injury defense, construction defect matters, and real estate litigation.

Ian counts among his regular clients the world’s largest soft drink manufacturer and bottler, the two largest pest control operators in the world, a major distributor of residential and agricultural chemicals, commercial landowners, and numerous general contractors and subcontractors from different trades. Over the past three decades, Ian has successfully defended claims made by plaintiffs seeking hundreds of millions of dollars.

Toxic Tort and Personal Injury Defense

In the area of toxic tort defense, Ian only represents defendants in all types of toxic tort cases, including chemical exposure, asbestosis cases, crop damage actions and Proposition 65 matters.

He has successfully defended some of the largest pesticide applicators in the United States in jury trials with claims arising out of alleged exposures to a large variety of hazardous substances, including pesticides, such as fumigants and organophosphates, and herbicides.

Ian has been successful in defending cases involving various claims of medical conditions such as “multiple chemical sensitivity,” “chronic fatigue immune deficiency syndrome” and “reactive airway dysfunction syndrome.” He has also successfully defended his clients on asbestos claims concerning mesothelioma.

In the area of personal injury defense, Ian represents the world’s largest soft drink manufacturer and bottler. He has successfully represented his client in wrongful death actions, product liability claims, “exploding bottle” litigation, slip and fall matters, and automobile liability defense.

Construction Defects and Real Estate Disputes

When matters of construction defect arise, Ian represents a variety of pest control operators, general contractors and subcontractors in breach of contract and negligence claims. He has successfully defended different trades in large, multi-party actions involving construction projects of more than ten million dollars.

Ian represents several large commercial property owners whose portfolios include shopping centers, malls and strip centers. He assists his clients in negotiating and renegotiating lease terms and in bringing suit to evict tenants who are in default of various provisions of their leases. He has successfully tried over a dozen cases to remove tenants and collect on unpaid rental arrears.

At trial, Ian has first chaired over two dozen jury trials to verdict and nearly three dozen bench trials to verdict. He has also first chaired an equal number of binding arbitrations to final award. A career-long member of the firm, Ian is a graduate of the University of California, Hasting College of Law and University of California, Santa Barbara. He clerked for the Hon. John P. Vukasin in the U.S. District Court for the Northern District of California.
